In these terms and conditions, “we” “us” and “our” refers to Thomas Moloney Pty Ltd. Your access to and use of all information on this website including purchase of our product/s is provided subject to the following terms and conditions. We reserve the right to amend this Notice at any time and your use of the website following any amendments will represent your agreement to be bound by these terms and conditions as amended. We therefore recommend that each time you access our website you read these terms and conditions.

Our Website Services

All prices are in American Dollars (USD). We endeavor to ensure that our pricing is accurate and current. Our prices are detailed within the individual product listings and we reserve the right to amend our prices at any time.

Receipt Of Incorrect Items

If you receive an incorrect item to the one ordered:
- Email us at rolacaseusa@usesi.com within 48 hours of delivery, after this time we will not accept responsibility.
- We will arrange collection of the goods to be returned and delivery of the correct item, at our cost.
- For “in stock” items, we aim to deliver the replaced goods within normal delivery time frames.
- For “out of stock” items we will refund 100% of the purchase price and part or all of the shipping costs.
All returned items must be returned in the original packing and care taken with re-packing to avoid damage during transit. Returned goods must be unused and in the original condition as shipped to you.

Receipt Of Damaged Products

We have a rigid quality control process and every product is thoroughly inspected before packaging and dispatch. Similarly, we use reputable couriers to ensure your goods arrive in perfect condition.
We encourage you to inspect your order for damages to packaging in the presence of the delivery courier prior to signing for receipt.
To arrange return of the damaged goods, ideally you should take a photograph of the damaged item immediately and notify us at rolacaseusa@usesi.com within 48 hours of delivery. After this time period we will not accept responsibility.
Details to be included in your email are:
- Your name, delivery address and telephone number.
- Original date of purchase and order number.
- A photograph of the damaged/faulty item
- Date of delivery, courier driver’s details, if available
You will be emailed a returns form for completion once your return has been approved.
We will arrange for the item to be collected and a replacement delivered to you at our cost. If a replacement item is not available we will refund you 100% of the purchase price.
All items must be returned to the original packing and care taken with re-packing to avoid further damage during transit. Returned goods must be unused and in the original condition shipped to you.
Refunds will be processed on receipt of the retuned items and we will endeavour to process your refund within 7 business days.
You will be notified by email to confirm we have processed your refund.

Late Delivery/Order Does Not Arrive

We encourage you keep track of your order. Where available, we will provide you with a tracking/consignment number and courier company details so you can track your parcel at all times.
It is your responsibility to advise us within 7 working days from notification of dispatch that you have not received your order. Once we are advised an order has not been received, we will make enquires to determine its location. A late delivery does not constitute a breach of your agreement with us and will not entitle you to cancel your order. Any delivery date quoted is an estimate only and we will not be liable for any loss or damage as a result of a late delivery of your order.

Product Descriptions

We strive to ensure that our products are described as accurately as possible on our website, however we do not warrant that the description is accurate. Where we become aware of any mis-description, we reserve the right to correct any error or omission.
Images have been provided for illustrative purposes only and we do not guarantee that any image will reproduce in true colour nor that any given image will reflect or portray the full design or options relating to that product.

Product Orders

We endeavor to ensure that our product listings are current however we give no undertaking as to the availability of any product advertised on our website.
All prices are in American Dollars (USD) and are inclusive of GST for American customers. We currently do not ship overseas Our prices are detailed within the individual product listings and we reserve the right to amend our prices at any time.
Packaging and postage may be an additional charge, this may be calculated at time of purchase in accordance with our shipping policy. All orders under $250.00 will incur a fee.
When you order from us, we require you to provide your name, address for delivery, your email address, telephone contact and credit card details. We undertake to take due care with this information; however in providing us with such information you accept that we are not liable for its misuse due to error in transmission or virus or malware.
We undertake to accept or reject your order immediately after placing such. We are not required to give reasons for rejecting your offer to purchase however the most likely reason for rejecting your offer will be that information provided to us appears to be incorrect or payment method has been declined. You will be advised if an item is out of stock.
Once you have submitted an order, you may not cancel that order even if our acceptance or rejection of your offer is still pending.
All risk of loss or damage to the goods passes to you when we dispatch the goods.

Order Cancellation Due To Error

Where a product has been listed at the incorrect price or with incorrect descriptive information or image due to typographical error or similar oversight, we reserve the right to cancel a transaction. Where your credit card has been charged, we will immediately refund your credit card for the total amount debited.

Product Returns

Once order is place goods cannot be returned.

When you visit our website, we give you a limited license to access and use our information for personal use.
You are permitted to download a copy of the information on this website to your computer for your personal use only provided that you do not delete or change any copyright symbol, trade mark or other proprietary notice. Your use of our content in any other way infringes our intellectual property rights.
